OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with being raised to heights via standing in an unapproved lift basket attachment that was attached to the forks of a powered industrial vehicle and without fall protection in place to prevent a fall from height:   On or about March 16, 2018, the employer failed to ensure that a lift basket attachment that was being used on the various powered industrial vehicles to elevate employees was either approved by the manufacture of the vehicle or by a qualified engineer.  Employees were being lifted up in this attachment without any fall protection in place, in order to access the loads on flatbed tractor trailers so that they could put a tarp over the product that was being shipped.  Heights being accessed via this means are approximately 10-13 feet (varies based on the load).  Powered industrial vehicles included a yellow Clark, Serial #GX230E-0683-9372FB, an orange Toyota, Serial #50551 and a blue Sunbelt, Serial #24041.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a  On or about March 16, 2018, the employer failed to ensure that employees who operated a powered industrial vehicle were currently trained as competent to operate.  Vehicles to include but not limited to:  Yellow Clark, Serial #GX230E-0683-9372FB, Orange Toyota, Serial #50551 and Blue Sunbelt, Serial #24041.  The last documented training occurred in May of 2014.

There were no OSHA logs established for this year.
