29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were made without the manufacturer's written approval: Note: If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly. On or about March 15, 2018, and in times prior thereto, Iron workers were "free rigging" off the forks of a forklift for a below-the-forks lifting of roof joists. This type of lift does not use an approved lifting attachment and it affects the capacity and safe operation of the forklift exposing workers to the hazard of being struck by metal joists.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: Section 605 A. Handle only stable or safely arranged loads. When handling off-center loads which cannot be centered, operate with caution: On or about March 15, 2018, and in times prior thereto, Iron workers were using the forks of a forklift for a below-the-forks lifting of roof joists. The load was off balance, exposing employees to the hazard of being struck by metal joist.

29 CFR 1926.858(b): The employer do not meet the requirements specified in 29 CFR 1926 subpart CC., 1425(c)(1) Keeping clear of the load. When employees are engaged in hooking, unhooking, or guiding the load, or in the initial connection of a load to a component or structure and are within the fall zone. The materials being hoisted were not rigged to prevent unintentional displacement: On or about March 14, 2018, and in times prior thereto, tagline operator was keeping a joist balanced while standing directly under the load exposing the worker to the hazard of being struck by the joist.
