OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Glen Dale: On or about March 16, 2018 and times prior, an employee was exposed to roll over and crushing injuries while traversing down a hill in a 2015 Polaris Ranger 570 to inspect a pipeline installation. The hill was a steep hill with a 24 degree slope (44% grade) and the employer did not ensure that the vehicle's doors or cab nets were installed on the vehicle.

29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) Glen Dale: On or about March 16, 2018 and times prior, an employee was exposed to struck by and crushing injuries while traveling down a hill in a 2015 Polaris Ranger 570 to inspect a pipeline installation. The employer did not ensure appropriate protective equipment such as a DOT approved helmet was utilized while operating the vehicle.
