29 CFR 1910.28(b)(1)(i): Each employee on a walking/working surface having an unprotected side or edge which was four feet (1.2m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Academy Distribution Center, Jeffersonvill, GA - Footwear Area - On or about March 19, 2018, and times prior to, employees were exposed to a fall when they climbed the racks without using a fall protection system to pick from the footwear department. Hooks provided by the employer to retrieve the shoe boxes on the back of the racks were not readily accessible to employees and/or there were not enough hooks available, especially for those coming from a different department to assist with picking. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.36(g)(2): The employer did not ensure that exit access routes were a minimum of 28 inches for storage aisle ways or alternatively 22 inches means of egress from permanently installed equipment as allowed by NFPA 101, Life Safety Code, 2009 edition (incorporate by reference) per 1910.35: Academy Distribution Center, Jeffersonville, GA - On or about March 19, 2018, and times prior to, the means of egress pathway from industrial equipment to an exit was reduced to less than the 22 inch minimum horizontal dimension required by NFPA 101, Life Safety Code, 2009 edition, Section 40.2.5.2.1, or 28 inches for storage aisles. During an emergency situation, employees working in passage ways, adjacent to this equipment, would be exposed to fire hazards. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed: Academy Distribution Center, Jeffersonville, GA -On or about March 19, 2018, and times prior to, the employer allowed unattended equipment and storage material to block aisle ways that could be used for egress to the nearest exit. The employer allowed powered industrial trucks (PIT's) and packaging to remain in the aisles during lunch and breaks, creating an egress hazard. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
