29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Arturo Gonzales was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR1926.501(b)(13), was contained in OSHA inspection number 1177643, citation number 1, item number 2 and was affirmed as a final order on October 12, 2016, with respect to a workplace located at 887A Via Selva Street, Tontitown, AR. 72770 On or about March 20, 2018, the employees working on a multi pitched steep roof, with the crew installing composite shingles greater than 6 feet above the ground, did not use of fall protection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Arturo Gonzales was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR1926.1053(b)(1), was contained in OSHA inspection number 1177643, citation number 1, item number 3 and was affirmed as a final order on October 12, 2016, with respect to a workplace located at 887A Via Selva Street, Tontitown, AR. 72770 On or about March 20, 2018 and times prior thereto, at or near the worksite located at 2021 West Gilligan Avenue, Rogers, Arkansas, employees used a portable ladder to access the roof that did not extend at least 3 feet above the roof. This condition exposed employees to fall hazards.
