29 CFR 1917.50(a): The employer used a material handling device listed in 29 CFR 1917.50(c) before ascertaining that the device had been certificated, as evidenced by current and valid documents attesting to compliance with the requirements in 29 CFR 1917.50(b). West of Pago Pago harbor at the net repair facility, the employer used material handling equipment that was not certificated, by persons currently accredited by the Occupational Safety and Health Administration, exposing employees to struck-by hazards.
