29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) On or about March 23, 2018, employees were exposed to fall hazards while working from a scaffolding platform attached to a fork lift at an elevation of approximately 18 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Rear of Building - on or about March 23, 2018, employees were exposed to the hazard of falling approximately 21 feet while performing carpentry work from second story top plates without the benefit of fall protection. b) Front of Building - on or about March 23, 2018, employees were exposed to the hazard of falling approximately 23 feet while performing carpentry work from pitched roof decking without the benefit of fall protection. J&M Construction & Services #1, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 1210156, citation 1, item 2, and was affirmed as a final order on April 18, 2017, with respect to a worksite located at 2236 Fir Street, Glenview, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
