OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls in excess of ten (10) foot from a mobile scaffold.    a) Facility, 420 North Washington Avenue, Scranton, PA - Employees were elevated on the work platform of a Genie Industries Model PLC-24 Genie Personnel Lift (Serial No. 14-89-19328B) without the lift being stabilized with all four (4) outriggers exposing the employees to a fall hazard of approximately twenty (20) foot above ground level on or about March 26, 2018.    In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1926.452(w)(6)(ii): Employee(s) were allowed to ride on a scaffold that had a height that was more than two times the base width and had not been designed and constructed to meet or exceed nationally recognized stability test requirements.    **NOTE: 29 CFR 1910.27(a): Scaffolds used in general industry did not meet the requirements in 29 CFR part 1926, subpart L (Scaffolds)    Facility, 420 North Washington Avenue, Scranton, PA - Employees on the elevated platform of a Genie Industries Model PLC-24 Genie Personnel Lift (Serial No. 14-89-19328B) were moved while the platform height of 144 inches was greater than four times (>4X) the base width of 29 inches exposing the employees to a fall hazard, on or about March 26, 2018.    In accordance with 1903.19, abatement certification and documentation is required for this violation.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    **NOTE: 29 CFR 1910.27(a): Scaffolds used in general industry did not meet the requirements in 29 CFR part 1926, subpart L (Scaffolds)    a) Facility, 420 North Washington Avenue, Scranton, PA - Employees elevated on a Genie Personnel Lift Model PLC-24 (Serial No. 14-89-19328B) did not recognize the hazards of working from an improperly stabilized lift and/or being moved on the lift and were exposed to fall hazards, on or about March 26, 2018.    In accordance with 1903.19, abatement certification and documentation is required for this violation.
