OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. a) Stone Ridge Estates - on or about March 27, 2018, an employee was working from a scaffold platform while being lifted to its working height by a telehandler, approximately 19 feet above grade, but the platform did not have guardrails installed nor was the employee utilizing personal fall protection equipment. Among others feasible means of abatement, one acceptable method is to follow ANSI B56.1-2005 entitled "Safety Standards for Low Reach and High Reach Trucks," Section 4.17 Elevating Personnel, c. which states "Be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyards, or deceleration devices, etc., are in place and properly used".

29 CFR 1926.451(c)(2)(v): The employer used a forklift to support a scaffold platform without ensuring that the platform was secured to the forklift while the platform was occupied: a) Stone Ridge Estates - on or about March 27, 2018, an employee was working from a scaffold platform being lifted to its working height by a telehandler, approximately 19 feet above grade, but the platform was not secured to the forklift while it was occupied.
