Suitability of equipment for an identified purpose may be evidenced by listing, labeling, or certification for that identified purpose. On and about March 26, 2018, employees of Elmstar Electric Corp. were exposed to shock hazards while using a Milwaukee Electric Tool Core Drill when the motor cord had a 15A plug on the cord the drill stand had been modified with a metal junction box housing a light switch and 15A outlet to power and control the 20A drill motor.

29 CFR 1926.405(e)(1): Cabinets, fittings, and boxes. Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in damp or wet locations shall be installed so as to prevent moisture or water from entering and accumulating within the enclosures. In wet locations the enclosures shall be weatherproof. On and about March 26, 2018, employees of Elmstar Electric Corp. were exposed to shock hazards while using a Milwaukee Electric Tool Core Drill when the original electrical components on the cord and drill stand had been replaced with non-waterproof components.

The employer shall establish and implement a written exposure control plan that contains at least the following elements: 29 CFR 1926.1153(g)(1)(i): A description of the tasks in the workplace that involve exposure to respirable crystalline silica; 29 CFR 1926.1153(g)(1)(ii): A description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task 29 CFR 1926.1153(g)(1)(iii): A description of the housekeeping measures used to limit employee exposure to respirable crystalline silica; 29 CFR 1926.1153(g)(1)(iv): A description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors. On and about March 26, 2018, employees were exposed to silica dust when a written exposure control plan had not been implemented to communicate the specific work practices needed to prevent employee exposure to silica.
