29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: At 3172 Morganford Road, St. Louis, MO, employees who entered the unprotected trench were not provided with a safe means of egress. These employees worked in between a 60-inch in diameter, concrete pipe and the west wall of the trench. There was a portable, extension ladder located in between the east wall and the 60-inch in diameter, concrete pipe. The extension ladder was obstructed by the concrete pipe. An earthen ramp existed at the east end of a trench that ran perpendicular to the trench where the employees were working. The distance between the employees and this ramp was approximately 37 feet.

29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: At 3172 Morganford Road, St. Louis, MO, employee(s) located inside of the trench with near vertical walls and no protective system in place were not removed from the caught-in hazard. Visible tension cracks along the west wall of the trench constituted an extremely hazardous condition. This violation was noted on 03/26/18.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: At 3172 Morganford Road, St. Louis, MO, employee(s) were observed inside of a trench in between the west wall and a 60-inch, concrete pipe. The west wall was measured at approximately 85 degrees from the horizontal. The wall had visible, stress cracks. Work was occurring during a downpour. The height of the west wall was measured at approximately five feet, three inches. No protective system was in place. This violation was noted on 03/26/18.
