OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees working around two post vehicle hoists.:    (a)Graham Tire LLC, at 2101 West 41st Street, Sioux Falls, SD 57105: On or about and at times prior to March 27, 2018, employees were exposed to serious crushing, caught-in and struck by hazards from falling loads due to a lift equalization cable on the Rotary two post lift being damaged.        Abatement Note: Among others, the following are feasible and acceptable abatement methods to abate the hazard:   1) Institute a preventative maintenance program in accordance with ANSI/ALI ALOIM.   2) Ensure employees do not use automotive lifts with deficient safety devices.   3) Ensure unsafe lifts are effectively locked out until repairs can be made by qualified personnel.

29 CFR 1910.305(b)(1)(ii): Unused openings in cabinets, boxes, and fittings were not effectively closed.    (a)Graham Tire LLC, at 2101 West 41st Street, Sioux Falls, SD 57105:  On or about and at times prior to March 27, 2018, theemployer did not ensure knockouts were closed over an open slot in the pendant outlet box powering the tire dismount machine located near the Hunter balancer in the work bay.  This condition exposed employees to shock and burn hazards.

29 CFR 1910.334(a)(2)(i): Employer did not ensure portable cord and plug connected equipment and flexible cord sets (extension cords) were visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket).     (a)Graham Tire LLC, 2101 at West 41st Street, Sioux Falls, SD 5710:  On or about and at times prior to March 27, 2018, theemployer did not inspect and repair or take out of service the flexible power cord attached to the tire dismount machine.  This cord was missing the outer jacket insulation.  This condition exposed the employees to the hazard of electrical shock and burns.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked:       (a)Graham Tire LLC, at 2101 West 41st Street, Sioux Falls, SD 57105:  On or about and at times prior to March 27, 2018, the employer did not protect employees from chemical hazards by in that containers of hazardous chemicals were unlabeled.  These chemicals included waste transmission fluid, antifreeze, floor cleaner and other unknown substances.     Abatement Note:  Labeling must include the following:    (i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or,  (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.

29 CFR 1910.132(d)(1): The employer did not asses  the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).   (a)Graham Tire, LLC. at 2101 West 41st Street, Sioux Falls, SD 57105:  On or about and at times prior to March 27, 2018, the employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment.   Tasks involving chemical, electrical, or other hazards were not assessed to determine PPE requirements.  Lack of a PPE Hazard assessment may prevent employees from choosing and using the correct PPE for a task.   Abatement Note: If such hazards are present, or likely to be present, the employer shall: Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; Communicate selection decisions to each affected employee; and, Select PPE that properly fits each affected employee. Note: Non-mandatory Appendix B contains an example of procedures that would comply with the requirement for a hazard assessment.
