29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels : (a) Production Area- On or about March 29, 2018, and at times prior, the employer exposed employees to noise hazards, in that the employer failed to provide annual audiograms to each employee exposed to noise levels above the Action Level of 85 dBA while welding and working with steel. An employee welding and working with steel was exposed to continuous noise at 81.10% of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 88.4 dBA during the 417 minute sampling period on March 29, 2018. The exposure calculation included a zero increment for the 63 minutes not sampled.

29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l) through a certification that included the name of the operator, the date of the training, that date of evaluation, and the identity of the person(s) performing the training or evaluation: (a) Throughout the facility- On or about, March 27, 2018, and at times prior, the employer exposed employees to a struck-by hazard, in that the employer did not certify that each forklift operator had been trained and evaluated by retaining records as documentation of the forklift operators' evaluations and/or training.
