29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) On or about March 1, 2018, and at times prior to that date, employees were exposed to fall injuries of approximately 22 feet while climbing on the guardrails of a scissor lift to access a commercial building roof and to reach a desired working position while attaching metal beams during steel erection activities, without the benefit of a fall protection system being in place.

29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide: (a) On or about March 1, 2018, and at times prior to that date, employees were exposed to fall injuries of approximately 22 feet while climbing on the guardrails of a scissor lift to access a commercial building roof and to reach a desired working position while attaching metal beams during steel erection activities, on a working platform that was not at least 18 inches wide.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems: (a) On or about March 2, 2018 and at times prior, employees were exposed to injuries from falls, while installing metal roof decking on a commercial building without the benefit of fall protection systems being in place. (b) On or about March 23, 2018 and at times prior, Hammers Construction, Inc., as a controlling employer, did not ensure that Montes Construction, LLC protected their employees from falls in excess of fifteen feet, while they were in the process of installing metal roof decking on a commercial building. An employee of Montes Construction, LLC suffered fatal injuries, when he fell approximately 22 feet to the lower working surface.
