29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On or about March 27, 2018, at a worksite located at 108th Street and Klem Road, Hales Corners, WI, employees did not use a safe means of access into and out of the trench. Employees accessed and egressed the trench by a small benched area that employee(s) stepped into that was 3 feet in depth and then entered/egressed into/from the main area of trench by stepping/jumping across utilities located at the bottom of the trench.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) On or about March 27, 2018, at a worksite located at 108th Street and Klem Road, Hales Corners, WI, employees were exposed to cave-in while conducting excavation of under ground utility cables in an unprotected trench. The employer did not conduct a daily trench inspection before starting work and during excavation activities to identify changing soil conditions and protective measures to be implemented.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On or about March 27, 2018, at a worksite located at 108th Street and Klem Road, Hales Corners, WI, employees worked in a six (6) foot deep trench for the purpose of exposing underground cables, were not protected from cave-ins by a protective system. This exposed employees to a crushing and struck-by hazard.
