29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Medart, Inc.- The employer had not developed and implemented a comprehensive hearing conservation program. On or about April 6, 2018, the following noise exposure was measured: A machinist was exposed to a mixed noise level of 88.4 dBA or an equivalent dose of 80.65%, as an 8-hour TWA, while conducting grinding operations. This level was based on 426 minutes of sampling; zero exposure was considered for the unsampled time.
