29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4): On or about April 18, 2018, at jobsite located 1224 Pope Lane Lake Worth, FL 33460, the employer had not developed or implemented an energy control program that describes the steps needed in order to ensure how the energy of each machine will be brought to a zero energy level, and how the machines will be tested to verify the zero energy state was obtained for each such as, but not limited to, Air compressor, DoAll Band Saw, Marvel Band Saw, CNC, Baileigh Cold Saw, Grizzy Dust Collector, Hebo Machines I and II, Romi Lathe, Edwards Punch Press, Niagara Punch Press and Kalamazoo Saw.

29 CFR 1910.147(c)(6): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed. The periodic inspection must: [A] be performed by an authorized employee other than the ones utilizing the energy control procedure being inspected. [B] be conducted to correct any deviations or inadequacies identified. [C] where lockout is used for energy control, include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected. [D] where tag-out is used for energy control, include a review between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section. On or about 4/18/2018, at jobsite located 1224 Pope Lane Lake Worth, FL 33460, the employer did not perform, at least annually, a review of the lockout/tagout program to ensure proper energy control procedures had been developed and any changes needed for energy control were incorporated into the program.
