OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a struck by hazard: On or about March 30, 2018, in front of a private residence located at 600 Island Drive, Palm Beach, FL. An employee was exposed to being struck by vehicular traffic while working standing in the right-of-way of a street without wearing a high-visibility safety vest. (MUTCD, 2009 Part 6, Section 6.D.03 Worker Safety Considerations).
