OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or from the operator falling off the forklift, due to the fact that operator restraint systems (seat belts) were not provided. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to install and to effectively enforce the use of the operator restraint systems during forklift operation. Also an employee was exposed to falls and struck-by-hazards while riding in the cargo area of a moving pickup truck. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to not allow employees to ride in the back of an open pickup truck and to require employees to ride in the cab of the truck with proper restraint systems. a) Ivy Road Lay-Down Yard: An employee operating a TCM forklift model 25, serial number VFHM500-34A, was observed not wearing a seat belt due to the forklift not being equipped with one. b) Saint Petersburg Road Fort Jackson, SC: On or about March 23, 2018 an employee was riding in the back of a Dodge 3500 pickup truck (temporary license 3015526) hauling a trailer containing portable toilets, and that employee fell out of the truck while it was traveling receiving multiple injuries resulting in hospitalization.

29 CFR 1910.176(c): Storage areas were not kept free from accumulation of materials that constituted hazards from tripping, fire, explosion or pest harborage: Ivy Road Lay-Down Yard: A small wooden building used to store items was found to be in disarray. The small shed contained items such as concrete mix, containers of Walex Exodor Alkaline Urinal Cleaner, cardboard boxes, containers, trash, toilet paper, paper towels, etc. all cluttered together which was a fire and tripping hazard and insects were noticed nesting inside. ABATEMENT CERTIFICATION IS REQUIRED
