29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)    At the commercial jobsite located at 183 NE HH Road in Warrensburg, Missouri: Employees engaged in masonry activities were exposed to injuries/illness from dermal, inhalation and ingestions hazards from exposure to hazardous chemicals. The jobsite did not have an adequate worksite-specific written respiratory protection program. Crystalline silica containing chemicals such as Ash Grove Pro Mix Core Fill Grout(60-100% crystalline silica) and Ash Grove Pro Mix Portland Lime Mortar Type S (72.5-79% crystalline silica) were mixed on site and silica containing masonry was occasionally dry-cut. The program was deficient in that:    - There were not procedures for selecting respirators;  - There were no medical evaluations of employees required to use respirators;  - There were not fit test procedures for tight-fitting respirators;  - It did not discuss training of employees in respiratory hazards to which they are potentially exposed to during routine & emergency situations;  - It did not discuss training of employees in the proper uses of respirators, including putting on and removing them, and limitations on their use and maintenance; and  - It did not discuss procedures for regularly evaluating the effectiveness of the program

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    At the commercial construction site located at 183 NE HH Road in Warrensburg, Missouri: Employees engaged in masonry mixing activities were exposed to injury/illness from dermal, ingestion and inhalation hazards from exposure to hazardous chemicals. The jobsite did not have an adequate worksite-specific written hazard communication program. Crystalline silica containing chemicals such as Ash Grove Pro Mix Core Fill Grout(60-100% crystalline silica) and Ash Grove Pro Mix Portland Lime Mortar Type S (72.5-79% crystalline silica) were used on site. The program was deficient in that:    - It does not include a list of hazardous chemicals known to be present on the jobsite;  - It does not include multi-employer workplace methods for sharing safety data sheets, precautions, or written programs;  - It does not discuss how the employer will ensure proper labeling is used;  - It does not discuss how and where the employer will maintain complete, up-to-date, safety data sheets or when they will be procured; and  - It does not discuss how and what information and training will be effectively provided to employees.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:    At the commercial construction site located at 183 NE HH Road in Warrensburg, MO; Employees engaged in masonry activities were exposed to illness from inhalation hazards from exposure to hazardous crystalline silica. Employee's exposures to airborne crystalline silica were not assessed:     (a) Employee exposures may reasonably have been expected to exceed the action level during mortar and grout mixing     (b) Employee exposures may reasonably have been expected to exceed the action level during dry block cutting operations.
