OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to serious struck-by/crushing hazards and/or death from falling tree limbs/trunk sections/branches.  Worksite: A tree felling safe zone/area preferably 1.5 times the height of the tree was not established and maintained around the 45 feet high oak/maple tree actively being removed by a worker positioned working elevated in the tree cutting tree branches, limbs and center tree trunk sections with a chain saw and lowering them to the ground using a ground worker and a rope.  On or about March 26, 2018, the ground worker while holding the rope on the ground was elevated approximately 12 feet above the ground after a large center tree trunk section was cut from the tree causing the trunk section to suddenly fall, striking the worker on the head as the worker was being elevated and then causing the worker to fall to the ground and the trunk section to land on the worker's head.
