29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  a)  At Lot 54 Rutland Lane, Highland Park, Spanish Fort, Alabama:  On or about April 3, 2018 and at times prior; the employer allowed his employees to operate pneumatic nail guns without wearing eye protection exposing his employees to struck-by hazards.  THE OLMAN FRANCISCO HERNANDEZ DBA OLMAN FRANCISCO HERNANDEZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.102(A)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1256195, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 26, 2017, WITH RESPECT TO A WORKPLACE LOCATED AT 11838 LODGEPOLE CT. SPANISH FORT, ALABAMA.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At Lot 54 Rutland Lane, Highland Park, Spanish Fort, Alabama:  On or about April 3, 2018 and at times prior; the employer allowed his employees to perform framing activities while standing in the trusses without fall protection exposing his employees to a fall hazard of 19 feet 6 inches to the concrete floor below.  b) At Lot 54 Rutland Lane, Highland Park, Spanish Fort, Alabama:  On or about April 6, 2018 and at times prior; the employer allowed his employees to perform framing activities while standing in the trusses and on roof decking without fall protection exposing his employees to fall hazards up to of 18 feet to the ground below.  THE OLMAN FRANCISCO HERNANDEZ DBA OLMAN FRANCISCO HERNANDEZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1256195, CITATION NUMBER 1, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 26, 2017, WITH RESPECT TO A WORKPLACE LOCATED AT 11838 LODGEPOLE CT. SPANISH FORT, ALABAMA AND IN OSHA INSPECTION NUMBER 1268245, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 15, 2017, WITH RESPECT TO A WORKPLACE LOCATED AT 33733 RUTLAND LANE, SPANISH FORT, ALABAMA.
