29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    a) KAD Contracting at 3200 Stanford Road Fort Collins, CO 80525:  On and before April 2, 2018, the employer did not ensure a competent person was designated to conduct frequent inspections to identify and correct hazardous conditions capable of causing injury. Laborers were performing maintenance work on wooden patios at Oakbrook I Apartments. Two laborers were working approximately 20 feet off the ground with the guardrails of the patio missing as well as part of the decking missing. These conditions exposed workers to fall hazards of approximately 20 feet.    OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to workers, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) KAD Contracting, LLC at 3200 Stanford Road Fort Collins, CO 80525: On or before April 2, 2018, the employer did not insure that employees were protected from fall hazards while performing maintenance work on patios. The employees were working on patios next to a leading edge without a fall protection system being used. Condition exposed employees to fall hazards of approximately 20 feet.
