29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:     On or about April 3rd, 2018, at the above addressed job site, employees were not protected from an approximate   28-feet fall hazard. Employees were located on the third floor of a residential structure under construction and in the process of dumping trash into a dumpster.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a.  On or about April 3rd, 2018, at the above addressed job site, an assessment was not conducted to determine if hazards are present and the need for personal protective equipment. Employees were located on the third floor balcony of a residential structure under construction and in the process of dumping trash into a dumpster.
