OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (a) Bear Creek Tower - On or about April 2, 2018, the employer was in the process of securing a waveguide ladder to the face of a communication tower and did not ensure an adequate number of friction clamps were installed before releasing the waveguide ladder from the crane, exposing employees to fall and struck-by hazards.

29 CFR 1926.251(a)(1): Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service. (a) Bear Creek Tower - On or about March 28, 2018 employees were exposed to a struck-by hazard while lifting components to erect a telecommunications tower during a construction project due to damaged slings. These slings contained rips, tears, and illegible tags with no weigh capacity on them. Also the user did not follow the manufacturers warning for replacement. (b) Bear Creek Tower - On or about April 2, 2018 employees were exposed to a struck-by hazard while lifting components to erect a telecommunications tower during a construction project due to damaged slings. These slings contained rips and tears. Also the user did not follow the manufacturers warning for replacement.
