29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.    a) 320 Rehoboth Avenue, Dogfish Head expansion, Rehoboth Beach, DE - On or about April 3, 2018, the employer failed to ensure employees had and used fall protection while working approximately 15 feet above the grade, exposing employees to fall hazards.     Delmarva Roofing & Coating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1194043, citation number 1, item number 1 and was affirmed as a final order on April 26,2017, with respect to a workplace located at 4719 S. Dupont Highway, Johnny Janosik Furniture Store, Camden, DE 19934.     Delmarva Roofing & Coating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1147873, citation number 1, item number 1a and was affirmed as a final order on August 16, 2016, with respect to a workplace located at 1574 N. Dupont Highway, Dover Towne Center, Dover, DE 19901.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):    a) 320 Rehoboth Avenue, Dogfish Head expansion, Rehoboth Beach, DE - On or about April 3, 2018, the employer failed to ensure employees used portable ladders at a safe angle or at least one-quarter of the working length of the ladder, exposing employees to fall hazards.     ABATEMENT NOTE:  The area around the top and bottom of ladders shall be kept clear.
