29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job-sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Carmel Partners at 201 E. Mississippi Ave., Denver, CO 80209: On and before April 3, 2018, the controlling employer did not ensure each subcontractor employee was protected from injury, in that brick layers were exposed to falls hazards ranging from approximately 20 feet to 60 feet due to inadequate guard rails and no ladder access on scaffolds on the west side of the apartment complex under construction. This condition exposed subcontractor employees to fall hazards ranging from 20 feet to 60 feet.
