29 CFR 1926.451(e)(6)(i): Prefabricated scaffold access frames shall be specifically designed and constructed for use as ladder rungs: (a) Barnes Construction Company at 201 E. Mississippi Ave., Denver, CO 80209: On and before April 3, 2018, the exposing employer did not ensure that fabricated access frames were specifically designed and constructed for use as ladder rungs in that employees climbed scaffold frames to access all levels of the tall narrow scaffold supported on the 3rd floor ledge on the west side (Sherman Street) of the building. This condition exposed the employees to falls of approximately 20 to over 60 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level: (a) Barnes Construction Company at 201 E. Mississippi Ave., Denver, CO 80209: On and before April 3, 2018, the exposing employer did not ensure that employees were protected from a fall from elevation in that guardrails or other suitable fall protection were not properly installed on the working platforms of two separate scaffolds on the west side (Sherman Street) of the building. Several employees were performing brick work from the scaffolds while both scaffolds lacked adequate guard rails on their sides and ends where the employees were working. This condition exposed the employees to falls of approximately 20-50 feet.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section: (a) Barnes Construction Company at 201 E. Mississippi Ave., Denver, CO 80209: On and before April 3, 2018, the exposing employer did not ensure that employees on the ground were protected from falling tools, materials or equipment in that toeboards or other suitable provisions of paragraphs (h)(2)(i)-(v) of this section were not implemented. Several employees were performing brick work from the elevated working levels of the scaffold on the west side (Sherman Street) of the building while it lacked toeboards in several areas. This condition exposed the employees working on the ground to falling object hazards.
