29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) On or about April 4, 2018, McPherson Contractors Inc., as controlling employer, did not ensure that employees of PJ Welding LLC, subcontractor, were protected from falls from Sky Jack SJIII 3219 scissors lifts in that the workers stood on the guardrails of the lifts while welding thereby defeating the protection of the guardrails. 29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement: (a) On or about April 4, 2018, McPherson Contractors Inc., as controlling employer, did not ensure that employees of PJ Welding LLC, subcontractor, were protected from impalement hazards on uncapped rebar at the northeast corner of the concrete slab of the construction project. Welders were working above the rebar when welding the bar joists and bridging.
