29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. a) At 152 Coosa Street, Montgomery, Al (1st Floor/Elevator Shaft Cut Area): On or about April 04, 2018, and at times prior thereto, the employer allowed their employees to perform construction, demolition and cleanup operations at or near an elevator shaft floor hole opening without fall protection exposing employees to fall hazards of approximately ten (10) feet to the basement level concrete floor below.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103) a) At 152 Coosa Street, Montgomery, Al (Building - All Levels): On or about April 04, 2018, and at times prior thereto, the employer allowed employees performing construction, demolition and clean-up operations to wear respirators in the work place without having been provided with the information contained in Appendix D of 29 CFR 191 0.134( c )(2)(i) exposing employees to respiratory and other hazards.
