29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) New residential construction located on Lot #109, Roof and top plate: On or about 04/06/2018, and at times prior, the employer exposed employee to struck-by hazards while operating pneumatic framing nail guns at 120 PSI, in that protective eyewear was not provided to employees engaged in framing activities.

29 CFR 1926.150(a)(1): The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and/or did not provide for the firefighting equiment as specified in this subpart:  (a) New residential construction located on Lot #109, All four sides of the structure: On or about 04/06/2018, and at times prior, the employer exposed employees to fire related hazards on the jobsite, in that fires were set to keep employees warm and there was no fire fighting equipment available to extinguisher the fires in the event there was an emergency.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  (a) New residential construction located on Lot #109, First floor and driveway: On or about 04/06/2018, and at times prior, the employer exposed employees to amputation hazards while operating circular saws, in that the lower guards were not operational during use as a wood shim was used to keep the lower guard in a fixed position.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a) New residential construction located on Lot #109, South side lower roof: On or about 04/06/2018, and at times prior, the employer exposed employees to fall hazards of 10-feet, 10-inches to the lower level, in that employees were not provided with a fall protection system while installing plywood sheathing on a 10/12 pitched roof.  (b) New residential construction located on Lot #109, Second floor top plate: On or about 04/06/2018, and at times prior, the employer exposed employees to fall hazards of 19-feet, 8-inches to the lower level, in that employees were not provided with a fall protection system while installing plywood sheathing.
