29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by competent persons designated by the employer: (a) Frisco Holiday Center LLC at 1121 Dillon Dam Road, Frisco, CO 80443: On or before April 4, 2018, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by competent persons designated by the employer. Fall hazards existed at this worksite that should have been corrected if the employer had initiated and maintained an inspection program. These conditions exposed subcontractor employees to fall hazards. OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to workers, and who has authorization to take prompt corrective measures to eliminate them.
