29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (a) Blue Pine Construction, Inc. at 4121 Green Ridge Drive, Laporte CO 80535: On or before March 16, 2018 where respirator use was not required, and where the employer permitted the voluntary use of N-95 filtering facepiece respirators, the employer did not provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"). This condition potentially exposed employees to respiratory hazards. Note: The requirements applicable to construction work under 1926.103 are identical to those set forth at 29 CFR 1910.134 of this chapter.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Blue Pine Construction, Inc. at 4121 Green Ridge Drive, Laporte CO 80535: On and before March 16, 2018 the employer did not provide each employee who wore a tight fitting negative pressure, half-face air-purifying respirator with a medical evaluation before respirator use. This condition exposed employees to potential medical complications during respirator use. Note: The requirements applicable to construction work under 1926.103 are identical to those set forth at 29 CFR 1910.134 of this chapter.
