29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about March 5, 2018; second-floor area; employees were not wearing head protection while working under or near employees that were conducting framing work.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about March 5, 2018; throughout the site; employees were exposed to a struck by hazard while operating a Paslode pneumatic nail gun without any eye protection.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a) On or about March 5, 2018; roof area of new addition; employees were walking the top-plate without fall protection in place to protect them from falling 30-feet to ground level.                         b) On or about March 5, 2018; second floor; employees were working near floor openings such as but not limited to the stair opening that was not guarded exposing them to a 10-foot fall to the lower level.    c) On or about March 5, 2018; second-floor area; employees were working near unguarded wall openings exposing them to a 20-foot fall to ground level.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training or  when employer relied on training conducted by another employer, the certification record needs to indicate the date the employer determined the prior training was adequate rather than the date of actual training, and the signature of the person who conducted the training or the signature of the employer.   a) On or about March 5, 2018; throughout the site; the employer relied on another employer's  fall protection training to employees that were exposed to fall hazards 6-feet and greater.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
