29 CFR 1926.1417(a): The employer did not comply with all manufacturer procedures applicable to the operational functions of equipment, including its use with attachments. a. On or about 04/05/2018, at the job site - the crane operator did not follow the crane manufacturer and safety procedures, he swung the boom and a load over personnel walking and coming out of the building through the designated access area, exposing the workers to a struck-by and crush-by hazard. The crane collapsed nearly striking workers on the ground.

29 CFR 1926.1417(o)(1): The equipment was operated in excess of its rated capacity: a. On or about 04/05/2018, at the job site - employees were exposed to struck-by and crush-by hazards, in that, the crane capacity was exceeded causing it to collapse, the crane was lifting a scissor lift that was being lowered to the ground level from a roof or terrace area. The distance of the crane from the lift was approximately 165 feet and the secondary hook was used.
