29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    a. On or about April 10, 2018, located at 108 Progress Drive in Danville, Ohio, employees were installing metal roofing material on an addition onto a Subway restaurant at heights between approximately 12 and 22 feet without fall protection. The employer never initiated or maintained safety and health programs to protect employees from the hazards associated with performing framing, truss installation and work on a steep-slope roof.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    a. On or about April 10, 2018, located at 108 Progress Drive in Danville, Ohio, employees were installing metal roofing material on an addition onto a Subway restaurant at heights between approximately 12 and 22 feet without fall protection. The employer never instructed employees in the recognition and avoidance of unsafe conditions with the regulations applicable to framing, truss installation and working on a steep-pitched roof in order to protect the employees from associated safety and health hazards.

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  a. On or about April 10, 2018, located at 108 Progress Drive in Danville, Ohio, employees were performing roofing work on a 5 in 12 inch pitch roof without any means of fall protection, thereby exposing the employees to a fall hazard between approximately 12 to 22 feet.   Flat Run Construction, LLC. was previously cited for an equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1203888, citation number 1, item number 1 and was affirmed as a final order on April 5, 2017, with respect to a workplace located at 7705 Ogdan Woods Blvd. New Albany, Ohio 43054.
