29 CFR 1910.146(d)(2): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not identify and evaluate the hazards of permit spaces before employees entered: a) 500 W. St. Bernard Hwy., Chalmette, LA; On or about March 31, 2018, the employer did not adequately identify and evaluate hazards inside a tower where employees were allowed to make a confined space entry. Employees were engulfed by material that was dislodged from the walls of the tower.

29 CFR 1910.146(k)(3): To facilitate non-entry rescue, retrieval systems or methods shall be used whenever an authorized entrant enters a permit space: a) 500 W. St. Bernard Hwy., Chalmette, LA; On or about March 31, 2018, employees were allowed to work inside a confined space (C-1213 Clay Tower) while not wearing a chest or full body harness or the use of another type of retrieval system, in the event non-entry rescue is necessary. Employees were engulfed by material that was dislodged from the walls of the tower.
