29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  (a)  Employees were exposed to cave-ins while conducting pipe connections in an unprotected trench.  The competent person (foreman) determined that the trench required cave-in protection, but failed to have the trench protection installed.   The Willkomm Excavating & Grading, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 995248, citation number 2, item number 1a and was affirmed as a final order on March 30, 2015, with respect to a workplace located at 112th Street and Burleigh Avenue in Wauwatosa, WI.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).    (a)  The employer did not ensure that employees working in an approximate eight (8) foot deep trench for the purpose of digging out the main line, were protected from cave-ins with an adequate protective system.  This exposed employees to a trench collapse and struck-by and soil engulfment hazard.    The Willkomm Excavating & Grading, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 995248, citation number 2, item number 1b and was affirmed as a final order on March 30, 2015, with respect to a workplace located at 112th Street and Burleigh Avenue in Wauwatosa, WI.
