29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition, the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety.   (a) On or about July 10, 2024, at a jobsite located at or near 444 Dardis Dr., Burlington, WI 53105, employees working in an approximately seven (7) foot deep class "C" soil unprotected excavation, were not removed by the competent person when exposed to cave-in hazard.

29 CFR  1926.652(a)(1): Each employee in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  (a) On or about July 10, 2024, at a jobsite located at or near 444 Dardis Dr., Burlington, WI 53105,  employees working in a trench excavation were exposed to cave-in and engulfment hazard while working in an excavation that was between five (5) and seven (7) feet deep without a protective shoring system in place.

29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.   (a) On or about July 10, 2024, at a jobsite located at or near 444 Dardis Dr., Burlington, WI 53105, employees working approximately five (5) to seven (7) feet below ground level in an excavation, were exposed to  struck-by hazards from tools and equipment, to include a Honda 2200 Generator, and other work related items located directly above and at or within 20 inches of the edge of the excavation without barricade or other means of restraint.
