29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a) Delmar Public Library - On or about November 6, 2017, the employer who is a sub-contractor elevated their employees to heights of approximately 20 feet above grade, on the forks of a (JLG) Skytrak 6042 Telehandler while standing on a temporary work platform (a stack of sheathing materials) which was not designed by or approved by the manufacturer.

29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:  a) Delmar Public Library - On or about November 6, 2017, the general contractor allowed employees of sub-contracted employer John Pagden to be lifted to heights of approximately 20 feet above grade while standing on a temporary work platform (a stack of sheathing materials) which was not secured to the forks of a (JLG) Skytrak 6042 Telehandler.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) Delmar Public Library - On or about November 6, 2017, the general contractor failed to ensure that employees of a sub-contractor Kevin Lane/DBA PNL  Construction, who were standing on a temporary work platform (a stack of sheathing materials) and elevated on the forks of a (JLG) Skytrak 6042 Telehandler to heights of approximately 20 feet above grade, were protected from fall hazards.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  a) Delmar Library, Delmar, DE - On or about November 6, 2017, the employer failed to ensure that employees were protected from fall hazards while engaged in roofing activities on a steep roof at heights of approximately 20 feet above grade.  a) Delmar Library, Delmar, DE - On or about November 6, 2017, the employer failed to ensure that employees were protected from fall hazards while transitioning from an elevated work platform to the roof and transferring roofing materials from the lift to the roof.
