OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard while working/walking in front of a structurally damaged rack system that was still in use. a) For employees working in the warehouse, on or about April 11, 2018, a storage rack system identified as 26E had been damaged by a powered industrial truck causing the support columns to be bent and the anchor bolt pads to be sheared off.
