29 CFR 1926.451(b)(1)(ii): Where the employer makes the demonstration provided for in paragraph (b)(1)(i) of this section, the platform shall be planked or decked as fully as possible and the remaining open space between the platform and the uprights shall not exceed 9 1/2 inches (24.1 cm). Exception to paragraph (b)(1): The requirement in paragraph (b)(1) to provide full planking or decking does not apply to platforms used solely as walkways or solely by employees performing scaffold erection or dismantling. In these situations, only the planking that the employer establishes is necessary to provide safe working conditions is required. On April 11, 2018 at 7791 WI Hwy 42 in Egg Harbor, employees who were working together to secure rafters to a ridge beam were working from scaffold on one plank at 20 feet above surface level without the platform fully decked between the scaffold uprights.

On April 11, 2018 at 7791 WI Hwy 42 in Egg Harbor, employees who were working together to secure rafters to a ridge beam were working from a scaffold work platform 20 feet above surface level without utilizing fall protection equipment.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On April 11, 2018 at 7791 WI Hwy 42 in Egg Harbor, employees who were on a roof securing rafters were working at 10 feet above surface level without utilizing fall protection equipment. b) On April 11, 2018 at 7791 WI Hwy 42 in Egg Harbor, employees were working in the rafter staging area on the second floor with an open edge 13 feet above surface level without utilizing fall protection equipment. The Van's Lumber & Custom Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1138220, citation number 01, item number 001 and was affirmed as a final order on May 5, 2016, with respect to a workplace located at 5274 Bayshore Dr.; Sturgeon Bay, WI 54235.
