29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) Production Areas -  On or about April 18, 2018, and at times prior, the employer exposed employees to noise hazards, in that the employer failed to implement a hearing conservation program for employees exposed to noise levels above the Action Level of 85 dBA.   An employee operating the intermediate jam mill was exposed to continuous noise at 103.5 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 90.3 dBA during the 424 minute sampling period on April 18, 2018. The exposure calculation included a zero increment for the 56 minutes not sampled.   An employee cutting vinyl in the processing area was exposed to continuous  noise at 66.9 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 87.1 dBA during the 456 minute sampling period on April 18, 2018. The exposure calculation included a zero increment for the 24 minutes not sampled.     An employee operating a saw to cut vinyl frames on line1900 was exposed to continuous  noise at 151.8 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 93.0 dBA during the 449 minute sampling period on April 18, 2018. The exposure calculation included a zero increment for the 31 minutes not sampled.  An employee using a drill while installing meeting rails on line 900 was exposed to continuous  noise at 89.4 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 89.1 dBA during the 429 minute sampling period on April 18, 2018. The exposure calculation included a zero increment for the 51 minutes not sampled.

29 CFR 1910.147(c)(6)(i): The employer did not conduct an annual or more frequent inspection of the specific energy control procedures to ensure that the procedures and requirements of this standard were followed:  (a) Production area- On or about April 12, 2018 and at times prior, the employer failed to annually review their lockout/tagout machine specific procedures to ensure that employees were correctly carrying out the energy control procedures for machines including, but not limited to, saws, milling, and welding machines.
