29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Temporary employees, controlled by Omni Construction Company, Inc., engaged in construction cleaning activities were exposed to fall hazards of approximately 25 feet from the edge of the balcony to the ground below, in that a fall protection system was not in place.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Temporary employees, controlled by Omni Construction Company, Inc., engaged in construction cleaning activities dumping trash into the forklift box were exposed to fall hazards of approximately 25 feet from the third floor balcony's edge to the ground below in that the employees were not trained on the means and methods of fall protection to minimize the hazards associated with falling from heights.
