29 CFR 1926.1101(k)(9)(vi): Training for employees performing Class IV operations was not consistent with the Environmental Protection Agency (EPA) requirements for training of local education agency maintenance and custodial staff as set forth at 40 CFR 763.92(a)(1): (a) Penthouse Mechanical Room - On or about April 11, 2018, Plumbers/Pipefitters were replacing pipe valves on pipes by removing the fiberglass insulation to with a few inches from the asbestos containing portion on pipes mark with an A and their employer had not provided them with asbestos awareness training. (b) Penthouse Mechanical Room - On or about April 11, 2018, Plumbers/Pipefitters were snaking a black hose through pipes mark with an A and attaching them to connectors on pipes mark with an A that had damaged pipe insulation and their employer did not provided them with asbestos awareness training. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
