On or about April 12, 2018, on the east side of a new construction residential condominium, an employee was working beneath employees installing framing materials was not wearing a hard hat, exposing the employee to the hazard of being struck by falling debris.

29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:    a.  On or about April 12, 2018, on the east side of a new construction residential condominium, an employee was using a pneumatic nail gun while installing framing materials and was not wearing eye protection, exposing the employee to the hazard of being struck by debris to the face and eyes.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    a.  On or about April 12, 2018, while framing a condominium, the employer was using an unapproved scaffold platform on the forks of a GEHL Telescopic forklift to lift an employee, exposing employees to a 19 foot 7 inch fall hazard.
