OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer failed to protect employees from crushed by hazards while performing landscaping and lawn mowing activities. This was most recently identified on April 13, 2018 at the establishment located at 233 E Norton Road, Springfield, Missouri. An employee was operating a SCAG brand, zero turn radius, riding lawnmower, Model: STC61V-27BS Serial Number J9500633, with roll bar down. The employer had not taken steps to ensure Roll Over Protective Structure (ROPS) were being used by employees while operating riding lawn mowers. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO: (1) Follow the Operator's Manual for the SCAG Tiger Cat Model STC61V-27BS Page 6, Keep the roll bar in the raised and locked position and the seat belt securely fastened during operation. Failure to do so could cause serious injury or loss of life. (2) Ensure employees are trained on the safe use of riding mowers to include the use of Roll Over Protective Structure (ROPS) and requirements in the Operator's Manual.
