29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Site work located at 838 Powder Springs Street, Marietta, GA: On or about 04/16/2018, and at times prior, the employer exposed employees to struck-by hazards while working in an unprotected excavation, in that head protection was not provided to employees working inside an excavation which loose soil, branches and mounds of dirt located overhead.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Site work located at 838 Powder Springs Street, Marietta, GA, Excavation: On or about 04/16/2018, and at times prior, the employer exposed employees to struck-by and engulfment hazards while working in an excavation which measured 9-ft. deep by 10-ft. wide by 18-feet long, in that the competent person failed to inspect the excavation prior to the start of work to provide cave-in protection and PPE needed to install storm drains into the manhole shaft.
