29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): (a) Forklift #42 (Nissan): On or about April 17, 2018, a rear light bar (operational and backup lights) were not working, and the propane tank was not mounted in alignment with the positioning bolt. (b) Forklift # 44 (Nissan): On or about April 17, 2018, backup lights and caution strobe light were not working, and the propane tank was not mounted on the positioning bolt. (c) Forklift # 1 (CAT): On or about April 17, 2018, the caution Strobe light was disconnected and front headlights were missing. (d) Forklift #47 (CAT): On or about August 15, 2018, the caution Strobe light and backup alarm were not working.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms were not kept clean. (a) The surfaces of the lunchroom were not kept clean and sanitary. The chip vending machine on it's dispensing chute in the employee lunch room was contaminated with manganese and cobalt metal dusts. This exposed employees to ingestion hazards such as but not limited to Manganism disease and cobalt poisoning.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) The written Hazard Communication program was not updated to incorporate the requirements of the Globally Harmonized System (GHS) of Chemical Classification of 2012. The employer did not update the program that required transition of the outdated Material Safety Data Sheets (MSDS) to the required GHS Safety Data Sheets (SDS) format. The written program reflected the requirements of MSDSs.
