29 CFR 1926.1053(b)(1): The side rails of portable ladders used for access did not extend at least 3 feet above the upper landing surface: a) Residential duplex 2122 40th Street West: On April 17, 2018 and at times prior, employees were exposed to fall hazards of approximately 9.5 feet to the ground from the roof surface with a pitch of 3:12 while ascending and descending the ladder used to removing shingles on the front side of the house and starting the dry in process on the back side of the house.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems: a) Residential duplex 2122 40th Street West: On April 17, 2018 and at times prior, employees were exposed to fall hazards of approximately 9.5 feet to the ground from the roof surface with a pitch of 3:12 while removing shingles on the front side of the house and starting the dry in process on the back side of the house. b) Residential duplex 2124 40th Street West: On April 17, 2018 and at times prior, employees were exposed to fall hazards of approximately 9.5 feet to the ground from the roof surface with a pitch of 3:12 while removing shingles on the front side of the house and starting the dry in process on the back side of the house. DG Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1166263, citation number 1, item number 1 and was affirmed as a final order on 9/8/2016, with respect to a workplace located at 1804 Arcadia Drive, Billings, MT 59102.
